Court Grants Preliminary Approval of $2.45 Million Settlement In Wage and Hour Class Action
McLaughlin & Stern, LLP and the Law Offices of Louis Ginsberg, P.C. are pleased to announce that Judge William F. Kuntz, United States District Judge for the United States District Court for the Eastern District of New York granted preliminary approval to a $2.45 million settlement in a wage and hour class action brought on behalf of hourly paid employees of Queens Long Island Medical Group P.C. (“QLIMG”). The action is captioned Siewharack v. Queens Long Island Medical Group P.C., (No. 11-cv-03602), and is currently pending in the Eastern District of New York.
The Complaint alleges QLIMG violated the Fair Labor Standards Act (“FLSA”) and New York Labor Law by causing QLIMG’s time-clock system to round down the amount of time employees were credited with having performed work at the company’s facilities. As a result, Plaintiff alleges that she and other non-exempt employees of QLIMG were not fully compensated for work performed before and after scheduled shifts and during meal breaks. Plaintiff alleges that hourly, non-exempt employees did not receive overtime for all hours worked over forty hours in a week. QLIMG has denied and continues to deny any wrongdoing and denies any and all liability and damages with respect to the alleged facts or causes of action asserted in the class action.
Pursuant to the settlement, QLIMG will create a settlement fund totaling $2,450,000.00 to compensate eligible class members, pay attorneys’ fees and expenses and cover settlement administration costs.
